Terms of Service

Talk2Gynae provides tools for sexual and reproductive health information, cycle and symptom tracking, and booking or messaging clinicians. The Services support—but do not replace—professional medical advice, diagnosis, or treatment. Always seek qualified care for medical concerns. In an emergency, contact local emergency services immediately.

You must be at least 16 years old (or the age of digital consent in your country, if higher) and able to form a binding contract to use the Services. You agree to provide accurate registration information and keep your login credentials confidential. You are responsible for activity under your account. Notify us promptly if you suspect unauthorised access.

You agree not to:

• Use the Services for any unlawful, harmful, fraudulent, or abusive purpose
• Harass, threaten, or discriminate against clinicians, staff, or other users
• Upload malware, scrape the Services without permission, or attempt to bypass security controls
• Impersonate another person or misrepresent your identity, credentials, or clinical needs
• Share another person's health information without lawful authority
• Interfere with or disrupt the Services, networks, or other users' access
• Use the Services to provide clinical care if you are not appropriately qualified and authorised
• Reverse engineer, copy, or resell the Services except as allowed by law

We may investigate suspected violations and take action, including suspending access and reporting to authorities when appropriate.

You are responsible for:

• The accuracy of information you submit (including cycle data, symptoms, pregnancy information, and medical history)
• Decisions you make based on insights, summaries, or educational content in the Services
• Keeping appointments you book, or cancelling according to any stated cancellation policy
• Paying applicable fees for paid consultations or features
• Following clinician instructions and seeking urgent care when symptoms require it
• Complying with these Terms and applicable law

Cycle predictions and self-check tools are informational estimates only. They are not a guarantee of fertility, pregnancy status, or clinical outcome.

Clinicians available through the Services are independent professionals. Talk2Gynae facilitates booking, messaging, and related platform features; it does not itself practise medicine. Clinical advice, prescriptions, and care decisions are between you and the clinician. Platform content is general information and may not apply to your circumstances.

Some Services require payment. Prices, currencies, and refund rules are shown at checkout or in product screens. Payments may be processed by third-party providers (such as Stripe or Flutterwave). You authorise us and those providers to charge the payment method you provide for amounts due.

The Services—including software, branding, logos, text, graphics, layouts, and documentation—are owned by Talk2Gynae or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial purposes in accordance with these Terms.

You retain rights in content you submit (such as notes and health records). You grant us a worldwide, non-exclusive licence to host, process, display, and transmit that content solely as needed to operate and improve the Services and provide care features you request. Feedback you send may be used freely to improve the product without obligation to you.

You may stop using the Services at any time and may delete your account or request data deletion through in-product privacy settings or by contacting us.

We may suspend or terminate your access if:

• You breach these Terms or our Privacy Policy
• We reasonably believe your account poses a security, legal, or safety risk
• Required by law or a regulator
• We discontinue the Services or a material part of them

Upon termination, your right to use the Services ends. Provisions that by nature should survive (including intellectual property, disclaimers, liability limits, and dispute resolution) will survive termination.

The Services are provided "as is" and "as available" to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation, or that insights and educational content will meet a particular clinical need. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity
• We are not liable for clinical outcomes, clinician acts or omissions, or decisions you make based on information in the Services
• Our total aggregate liability arising out of or relating to the Services or these Terms is limited to the greater of (a) the amounts you paid us for the Services in the 12 months before the claim, or (b) ₦50,000

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

You agree to indemnify and hold harmless Talk2Gynae and its officers, employees, and partners from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services, your content, or your breach of these Terms, except to the extent caused by our wilful misconduct.

These Terms are governed by the laws of the Federal Republic of Nigeria. Subject to any mandatory consumer protections where you live, the courts of Nigeria have exclusive jurisdiction over disputes arising from these Terms or the Services. Nothing in this section prevents either party from seeking interim injunctive relief in any competent court.

We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. If changes are material, we may provide additional notice. Continued use after the effective date constitutes acceptance of the updated Terms where permitted by law.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any product-specific policies referenced in the Services, are the entire agreement between you and us regarding the Services.
